Public Platform: Public Interest Provisions in Merger Regulation

The assessment standard for public interest issues in merger analysis has become controversial, as highlighted by the Walmart/Massmart and Metropolitan/Momentum mergers. To provide clarity on the assessment of public interest provisions in merger analysis, the Competition Commission has published draft guidelines for public comment.

Given the wide range of views and perspectives on the matter, CCRED is holding a panel debate with different stakeholders to debate key issues raised by recent cases and the extent to which the guidelines address these challenges.

Expert panel includes; Hardin Ratshisusu (Competition Commission), Simon Roberts (CCRED), Duma Gqubule (KIO Advisory Services), Norma Craven (Numsa) and chaired by Yasmin Carrim (Competition Tribunal).
