Economics for Competition and Regulation, 19 & 20 August 2015

Now being offered for the third year running, this course will cover key principles in competition economics and regulation. It is targeted at competition practitioners and those with competition responsibilities in regulatory agencies and companies. The course will cover the appropriate tests, evidence and assessment needed to analyse specific competition matters in mergers, coordinated conduct, restrictive vertical practices and abuse of dominance cases.
The course will have a strong focus on how the principles are applied in practice, taught by means of lectures on theory, practical case studies and using hypothetical case scenarios where participants apply lessons learnt during the sessions. Feedback sessions where the hypothetical cases will be debated from the perspective of different stakeholders will give the participants an opportunity to test their understanding. Both sessions will draw on recent experience in Kenya as well as other jurisdictions.
Main facilitators for this two-day course include Professor Simon Roberts (Director of the Centre for Competition, Regulation and Economic Development (CCRED) at the University of Johannesburg), Dr Javier Tapia and Ms Reena das Nair (Senior Researcher at CCRED).
The course is organised by the Centre for Competition, Regulation and Economic Development (CCRED) of the University of Johannesburg and a certificate of attendance will be awarded to participants.

Law for Economic Regulation & Competition, 18 – 20 August 2015

The course is targeted at staff of competition authorities and regulators in East Africa who are involved in investigating and deciding on conduct of firms. The course will cover key legal concepts in regulation and the challenges facing legal practitioners, investigators and analysts in applying these to particular sectors and markets. The course will also provide legal and practical guidance on how to initiate an investigation, obtain evidence, including through subpoenas and summonses, conduct on-site inspections and search and seizure operations, hold interviews and interrogations; as well as how to write investigation reports, hold hearings and handle the confidentiality and privilege challenges that could arise. Sessions will further cover procedural and practical issues with negotiating settlements and resolving disputes, litigation strategies and tactics. The course will also debate pertinent issues of concurrent jurisdiction between competition and regulatory authorities.
This three-day course will be facilitated by highly experienced academics and practitioners including Professor Jonathan Klaaren (professor at the School of Law at the University of the Witwatersrand (WITS) and former Director of the Nelson Mandela Institute at WITS), Ms Wendy Ndlovu (Manager in the Office of the Commissioner and former Chief Legal counsel at the Competition Commission of South Africa), Mr Makgale Mohlala (Divisional Manager of the Cartels Division at the Competition Commission of South Africa); Dr Javier Tapia (Judge at the Competition Tribunal of the Republic of Chile, member of the Centre for Regulation and Competition at Universidad de Chile, Faculty of Law), and Professor Patricia G. Kameri-Mbote (Professor of Law and Dean at the School of Law, University of Nairobi and an advocate of the High Court of Kenya).
